3.3 While we try to keep the website up-to-date and accurate, we cannot guarantee it will always work perfectly or be free from bugs or viruses. Customers use the website at their own risk. We are not liable for any loss of data or damage caused by using the website.

3.4 Our website offers a range of products for sale. Where we refer to an ‘item’ or ‘product’ we are referring to a single product available for purchase on this website.

3.5 The Artisan Garden will take reasonable care to ensure the details displayed for a particular product for sale are correct at the time when the information was entered onto the system.

3.6 Whilst care is taken to ensure that we display as accurately as possible, appearances, colours, textures or finishes, what you see on your computer monitor or equipment may differ, and so we cannot guarantee that images are an accurate representation of the actual products that you are purchasing.

4.2 Upon placing an order for a product, you agree to The Artisan Garden holding your information on databases and accounting services.

4.3 The Artisan Garden will not pass on your details to a third party, except to fulfil service obligations for instance, by passing your address details to a delivery courier/supplier.

4.4 The Artisan Garden will securely remove your details from records at any time upon receipt of your written instruction to do so and will retain only the information required by law and HMRC.

 

5. ORDERS AND PAYMENTS

5.1 The Artisan Garden may not be able to accept your order for many reasons, including but not limited to:

i) The item you have ordered is out of stock

ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

iii) There has been a pricing or product description error

iv) There is a system or procurement failure

v) You have failed our customer validation checks.

5.2 When you place an order, you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

5.3 Your order will only be accepted by us once your payment has cleared funds in our account.

5.4 The price you pay is the one shown on the website when you place your order. If there’s a pricing error beyond our control, we will let you know as soon as possible and offer the choice to reconfirm your order at the correct price or cancel it. If we cannot contact you, we’ll cancel the order and refund you.

5.5 The Artisan Garden accept payment by credit/debit card only and all payments are completed online, through our website.

5.6 Prices shown include VAT (where applicable).

5.7 The Artisan Garden are unable to provide any payments by instalments.

5.8 The Artisan Garden do not take payments over the phone.

5.9 Delivery charges will be visible at checkout.

5.10 You won’t be able to access your order history online, so we recommend printing your order confirmation and these terms and conditions. If you need details of past orders, please contact us by email info@theartisangarden.co.uk and we will endeavour to assist.

6. DELIVERY

6.1 The Artisan Garden deliver locally (within 15 miles of GU6) or a courier will be subcontracted to deliver your order if you live outside of our local delivery service. An adult aged 18 years or over must be present to accept the delivery. If you are unable to be present for the delivery, please inform The Artisan Garden in advance, in writing of the recipient’s name.

6.2 Delivery charges will be visible at checkout.

6.3 The Artisan Garden can only deliver each order to one address. If you want products sent to multiple addresses, you’ll need to place separate orders.

6.4 Delivery times and dates will be arranged by email once payment has been received.

6.5 Delivery times vary for each product and while we aim to meet these times, delays that are out of our control, can happen. If a delay is expected, we’ll let you know and give you an option to cancel or continue with the order.

6.6 Unless otherwise stated, deliveries are made to your doorstep only. We (and our couriers) are not insured to enter your home or assist with moving, assembling or installing products.

6.7 Responsibility and liability for the products passes to you once they’ve been delivered.

6.8 The Artisan Garden do not offer "next day delivery" for any of our products.

 

7. COLLECTION

7.1 Our products are also available for collection; however, we reserve the right to refuse collection.

7.2 Collections will be arranged separately by email once your payment has cleared our account. You will then be advised of the collection address, date and time.

7.3 Upon collection, please ensure you bring your order confirmation email as ID.

7.4 Responsibility and liability for the products passes to you once they’ve been collected.

 

8. ORDER CANCELLATION

8.1 If you wish to cancel an order you have placed you must contact The Artisan Garden by email to ascertain whether the products have been dispatched or not.

8.2 Where products have been dispatched you have 14 days from receipt of goods to change your mind. Return delivery costs are payable by you, and we recommend a recorded delivery method is used. Refunds will be issued within 14 days of us receiving your returned products. The Artisan Garden reserves the right to not refund in full or at all should an item be returned in a damaged condition or without all its original packaging.

8.3 Where products have not been dispatched a refund will be issued within 14 days.

8.4 The Artisan Garden can arrange collection (within a 15-mile radius of GU6) for a product you wish to return. The collection cost will be advised to you and deducted from your refund.

9. RETURN POLICY

9.1 Our return policy is designed to give you confidence in your purchases from us. If for any reason you are not satisfied with your order, we will be happy to discuss a refund.

9.2 If you wish to return a product you have 14 days from receipt of goods to contact us by email to initiate the return process.

9.3 Ensure that the item is in its original condition and with all its original packaging.

9.4 The Artisan Garden are not liable for any damage to any returned products. Once the product has been received by us and checked that it is in the same condition as to which it was sold, your refund will be processed within 14 days.

9.5 The Artisan Garden reserves the right to not refund in full or at all should an item be returned in a damaged condition or without all its original packaging.

11.1 The Artisan Garden always endeavours to provide the best service. However, on rare occasions there may be times where a customer may not be completely satisfied. To ensure The Artisan Garden can put things right for you, please contact us straight away by phone, email or in writing.

11.2 On receipt of your complaint The Artisan Garden aims to respond within 5 days.

 

12. OTHER IMPORTANT INFORMATION

12.1 These terms and conditions will be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.

12.2 Our products are designed for domestic use. If you’re buying for business use, please ensure you have suitable insurance.

12.3 The Artisan Garden are not responsible for delays caused by events beyond our control (such as adverse weather, strikes, courier delivery failures/delays or supplier issues).

12.4 The Artisan Garden may include links to other websites for your convenience. We’re not responsible for their content, privacy policies, or how you use them.

12.5 The Artisan Garden shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any products that have been ordered on the website.

12.6 You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.
